SUBJECT:     Temporary Waiver of New Mexico Chile Verification and Record Requirements 21.16.7.10 NMAC.

Effective immediately, the New Mexico Department of Agriculture (NMDA) is issuing a temporary waiver of the New Mexico Chile Advertising Act 21.16.7.10 NMAC, Verification and Record Requirements, through June 30, 2022.


This temporary waiver is being issued to allow NMDA to implement a revised process for fresh and processed chile vendor verification and implement a verification website as outlined in 21.16.7 NMAC. This revised process will streamline chile vendor verification paperwork and audits. It will also provide a public webpage that lists all fresh and processed chile product vendors that have submitted verification forms.

NMDA plans to host an industry wide meeting to assist vendors in navigating the revised process associated with this waiver. Once set, the date and agenda for the proposed industry meeting will be posted on NMDA’s website as well as other publications and on social media.
