Registering Pesticides and Devices in New Mexico
Pesticides and devices must be registered before they can be offered for sale in New Mexico.
Pesticide Registration Application Form
These products are registered by their marketing label, not their active ingredient or EPA number. Each label must be registered. For instance, if the product is marketed with different fragrances, alternate brand names, "lock and load" or water-soluble bags, etc., each different fragrance, formula, etc. must be registered.
On the application form list the pesticide's classification, product name and EPA registration number, where applicable, for each pesticide or device to be registered. Additional pesticides or devices may be listed on separate sheets of paper or computer print-out. The additional sheets need to be signed and dated.
Submit the
application form, labels, and registration fees to NMDA.
A certificate listing your registered products will be returned to you. The complete registration process can take between three to six weeks; devices or 25(b) products can take up to six months or longer.
INCLUDE LABELS AND LABELING
One copy of the label and other pertinent written, printed or graphic matter (supplemental labels, technical bulletins, etc.) must accompany the application. Include EPA form 8570, Notice of Supplemental Distribution, with any supplementally distributed products.
FEES
The annual registration fee is $75 per product. Special registrations (such as experimental use permits, Section 18 exemptions, and 24c exemptions) are not subject to the registration fee if their parent product is registered. Make checks payable to NMDA.
RENEWALS
New Mexico pesticide registrations expire on December 31 following the date of issuance. You will receive a form to renew your registrations. Make any necessary corrections to the form and return with your fees by January 31. Renewals postmarked after January 31 must pay double fees ($150 per product).
