25(b) Fact Sheet

Information for Registrants

The New Mexico Department of Agriculture requires any products or devices distributed in the state to be registered as pesticides if they make pesticidal claims.  Items exempted by EPA under FIFRA Section 25(b) are not exempt from registration by NMDA.

To register EPA-exempt products in New Mexico, registrants must submit the following:

  1. A full description of the tests and results upon which the claims are based (efficacy data).  In order to fulfill this requirement, data must support the claims made for the product.  Data must be from independently collected, double-blind, replicated studies that have been peer reviewed.  The information should include comparisons to industry standards and must describe the experimental design; materials and methods; results and analysis using standard scientific statistical methods; an interpretation of those results; and the names and addresses of researchers who conducted the studies.  Testimonials, in-house studies, or similar materials are not acceptable.
  2. A complete description of the contents of the pesticide, including all active ingredients (any ingredients that will prevent, destroy, repel, control or mitigate pests; act as a plant regulator, defoliant, or desiccant; or act as a functioning agent in a spray adjuvant) plus all inert ingredients. Active plus inert ingredients must total 100%.
  3. A copy of all labeling accompanying the pesticide or device, and a statement of all claims, including directions and precautions for use.
  4. Completed Pesticide Registration Application Form.
  5. Registration fee ($75 per product).

The product will be registered if its composition and efficacy data warrant the proposed claims made for it, and if the pesticide or device and its labeling and other material submitted comply with the requirements of the New Mexico Pesticide Control Act.
