Consumer Services inspects weighing and measuring devices annually that are used commercially. These devices are inspected and tested in accordance with the specifications and tolerances as set forth in the National Institute of Standards and Technology (NIST) Handbook 44. The purpose of this inspection is to ensure that these devices are weighing and measuring accurately. They are inspected using calibrated test standards. On average approximately 7,000 weighing and measuring devices are inspected annually in the State of New Mexico. Approximately 6% of those devices are placed Out-of-Order for not meeting specifications.

Petroleum standards is responsible for the annual inspection and testing of all commercial petroleum measuring devices used in the state as well as ensuring product quality for gasoline, diesel, kerosene, brake fluid, antifreeze, and lubricating oil. Currently, 12 inspectors are stationed throughout New Mexico performing these activities. Regulatory activities administered by the bureau are performed under the authority of the Petroleum Products Standards Act (57-19-25 through 57-19-37 NMSA 1978) and seven rules adopted under it.

Inspections are unannounced and random with all commercial devices in the state usually tested at 12-month intervals.

Devices found not to be in compliance are placed out of service until repaired by service agencies licensed with the department or reinspected by the NMDA inspectors.

Petroleum products that do not meet standards are placed off sale until corrected or replaced.
