Agricultural Water Conservation Tax Credit Rules

New Mexico Department of Agriculture has promulgated administrative rules pursuant to Chapter 7, Article 2, Section 18.20 New Mexico Statutes Annotated 1978, and Chapter 7, Article, 2A, Section 22 New Mexico Statutes Annotated 1978; subsections 72-2-18.20 (G) New Mexico Statutes Annotated 1978 and 7-2A-22 (F) New Mexico Statutes Annotated 1978. 
 
Both statutes and subsections direct New Mexico Department of Agriculture to promulgate administrative rules for implementation of an agriculture water conservation tax credit.  New Mexico Department of Agriculture engaged the required agencies and the public in the development of the rule.  Notice of proposed rule making was published in the NM Register on August 29, 2008.  Written comments were solicited in that notice.

On September 22, 2008, New Mexico Department of Agriculture conducted a public hearing to receive comment on the agriculture water conservation tax credit rule.  The New Mexico State University Board of Regents approved the rules on October 30, 2008. 

The rules became effective upon publication in the New Mexico Register on December 1, 2008.  Please click on the following link to access the rule on the New Mexico Register web site.  The tax credit rules are listed at the top under the heading "Agriculture, Department of".
