Feed Registration and Tonnage
New Mexico Commercial Feed Law and 21 NMAC 18.3 Commercial Feeds require any person who manufactures a commercial feed in this state, is a distributor of a commercial feed, or whose name appears on a commercial feed label as guarantor, must first obtain from the department a commercial feed registration certificate for each commercial feed that is distributed in New Mexico.
The annual commercial feed registration is obtained by submitting a completed Commercial Feed Registration Application (application continuation form also available), a complete, legible label for each product being registered and fees. The application must be filled out completely and accurately listing the complete product name for each product being registered, and indicate all sizes that the product is distributed in parenthetically after the product name.
Registration Information
In New Mexico, products are registered by the individual label. Registration fees are $2.00 per product in any size quantities. There is a $25.00 annual inspection fee per product if distributed in quantities of 10 pounds or less in lieu of the quarterly inspection fees. For products distributed in quantities greater than 10 pounds, there is a quarterly tonnage fee of $0.15 per ton that is reported and paid quarterly. If you are distributing products (including samples) in 10 pound (or less) packages and packages greater than 10 pounds, both the $25.00 inspection fees and tonnage fees are required for those products. There is no exemption for sample size containers.
Registrations expire December 31 annually. Registration renewal applications are mailed approximately six weeks before the expiration date.
Notifying NMDA of Label Revisions (required or company changes)
Please utilize the Label Revision Notification Form to submit all commercial feed (including pet food/treats) label revisions to our office during the year. This form is not necessary during the renewal application period. Please include on the form your NMDA Company ID, NMDA Product ID, product name as previously registered, revisions made, and product size where indicated. Please include the NMDA Product ID on the label you are submitting as well. There are many labels with similar names and this will assist us in processing your changes and will result in accurate replacement of revised labels.
Inspection Fees
NMCFL 76-19 Section 6 A.- “There shall be paid to the board for all commercial feeds distributed in New Mexico an inspection fee not to exceed fifteen cents ($.15) per ton”. This fee applies only to products distributed in packages of over ten pounds and/or in bulk. These fees are to be reported and paid on a quarterly basis on forms furnished by NMDA. Quarterly tonnage reports are mailed approximately two weeks before the end of each quarter to each registrant that is required to report tonnage. The tonnage report and fees are due within 30 days after the close of each calendar quarter. A report is required whether or not sales have been made.
Penalties
If any quarterly report is not filed, or if the inspection fee is not paid within the 30-day period after the end of the quarter, a penalty of twenty percent (20%) or a sum of $10, whichever is greater, will be due in addition to the inspection fee.
